TERMS AND CONDITIONS
These Terms and Conditions of Sale (“Terms”) govern the sale of products and services (“Products”) by MOVE YOUR SASS (referred to as “we”, “us”, or “our”) to you, the customer (“you” or “your”), through our website located at www.moveyoursass.com.
By placing an order for Products on our website, you agree to be bound by these Terms. Please read these Terms carefully before placing your order. If you do not agree with any part of these Terms, please do not place an order.
- Ordering and Acceptance
1.1. All orders for Products placed through our website are subject to availability and acceptance by us. We reserve the right to reject any order for any reason at any time.
1.2. After you place an order, you will receive an email from us acknowledging that we have received your order. This acknowledgment does not constitute acceptance of your order. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the Product has been dispatched (“Dispatch Confirmation”). The contract between us will only be formed when we send you the Dispatch Confirmation.
1.3. The contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products that may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
- Prices and Payment
2.1. The price of the Products will be as quoted on our website at the time you submit your order. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the website.
2.2. Prices for our Products may change from time to time, but changes will not affect any order for which we have already sent you a Dispatch Confirmation.
2.3. The price of a Product does not include delivery charges. Our delivery charges are as quoted on our website from time to time.
2.4. Payment for all orders must be made by Credit Card at the time of placing the order. We will not dispatch the Products until we have received full payment.
- Delivery
3.1. We will deliver the Products to the delivery address specified in your order. We will use reasonable efforts to deliver the Products within the estimated delivery time frame provided to you at the time of placing the order, but we do not guarantee that the delivery will be made within this time frame.
3.2. If for any reason we are unable to deliver the Products to you within the estimated delivery time frame, we will contact you to inform you of the delay and provide you with a new estimated delivery time frame. If the delay is significant, you may have the right to cancel your order and receive a refund for any Products that you have paid for but not received.
3.3. Delivery will be completed when we deliver the Products to the address specified in your order. The Products will be your responsibility from the completion of delivery.
- Returns, Refunds and Exchanges
4.1. We hope that you will be delighted with your purchase, but if for any reason you are not completely satisfied, you may return the Products to us in accordance with our Returns Policy, which is available on our website.
4.2. If you wish to return a Product, you must notify us within 7 days of receiving the Product and return the Product to us in its original condition and packaging within 7 days of notifying us of your intention to return the Product.
4.3. If you return a Product to us because you have canceled the contract between us within the 7 days, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Product in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.
4.4. If you wish to return a Product for an exchange, you must notify us within 7 days of receiving the Product and return the Product to us in its original condition and packaging within 7 days of notifying us of your intention to exchange the Product.
4.5. Exchanges will be subject to the following conditions:

- The Product must be in its original, unused condition, with all tags and labels attached.
- The Product must be accompanied by proof of purchase.
- The Product must be returned in its original packaging.
4.6. If the exchange is due to a change in size or color preference, and the desired size or color is available, we will process the exchange as soon as possible after receiving the returned Product. If the desired size or color is not available, we will issue you a refund in accordance with our refund policy.
4.7. If the exchange is due to a defect in the Product or an error on our part, we will bear the cost of shipping the replacement Product to you.

Disclaimer: This Exchange Policy is subject to the Terms and Conditions outlined above. In the event of any inconsistency between this Exchange Policy and the Terms and Conditions, the Terms and Conditions shall prevail.
4.9. If you return a Product to us for any other reason (for example, because you have notified us that you do not agree to a change in these Terms or in any of our policies, or because you claim that the Product is defective), we will examine the returned Product and notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund. We will refund the price of a defective Product in full, any applicable delivery charges, and any reasonable costs you incur in returning the item to us.
- Limitation of Liability
5.1. Nothing in these Terms shall limit or exclude our liability for:

- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability which cannot be limited or excluded by applicable law.
5.2. Subject to Section 5.1, we will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any:

- loss of profit, sales, business, or revenue;
- loss of business opportunity;
- loss of anticipated savings;
- loss of goodwill;
- loss of reputation;
- any indirect or consequential loss or damage.
5.3. Subject to Section 5.1, our total liability to you for all losses arising under or in connection with the contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you for the Products under such contract.
- Governing Law and Jurisdiction
6.1. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the United Arab Emirates.
6.2. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the laws of the United Arab Emirates.
- Changes to Terms and Conditions
7.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
7.2. By continuing to access or use our Website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Website.
